Irrigation
and Drainage
Modern West, Inc. guaranties and warrants any and all irrigation and
drainage systems
installed
by Modern Inc. West, Inc. pursuant to the terms of this Agreement shall be free
from
defects in material and workmanship for a period of one (1) year from
installation of
such
irrigation and drainage systems. As
used in this subsection (c), the phrase “free from
defects
in material and workmanship” shall mean that such irrigation systems are
capable of
performing
their intended functions so as to satisfactorily irrigate and drain all plant
material
on the property and do not leak, flood or otherwise cause exceedingly wet soils
conditions
to exist on Project Owner’s property.
