SOFTSCAPE WARRANTY
Modern
West, Inc. guarantees any and all plant material installed by Modern West, Inc.
pursuant to the
terms
outlined below:
1. Trees: Guaranteed from dying for a period of ninety (90) days from installation unless
otherwise specified in the under the “Special Provisions” section of the contract, or subsequent
change
orders.
2.
Shrubs: Guaranteed
for a period of ninety (90) days from installation.
3.
Annual Color:
No Guarantee.
4.
Ground Cover and/or Sod:
Guaranteed for a period of ninety (90) days from installation.
As
used herein, the term “dying” shall mean that the plant material no longer
exhibits any signs of life whatsoever and is not otherwise in its dormant state
pursuant to its normal seasonal cycles.
